When determining custody, the court looks at where the child lives and which parent makes health, religion, education and other day-to-day decisions for the child. Unless there are extreme circumstances, Florida favors the idea of sharing time and decision making between parents.

Child Support Factors

When reviewing child support payment plans, the court looks at several factors to make a decision. Some of the factors the court looks at to determine child support include:

  • Income of both parents
  • Parental involvement
  • Health insurance
  • Daycare expenses
  • Number of children

It is possible to deviate from the statutory formula, but we must have a compelling argument. For example, a child may have extraordinary medical expenses.

Modifying Court Orders

It is possible to modify any court order that will impact the child. If we can show that the request is based on the best interests of your child, you may win the modification. However, you must show a substantial change in circumstances to justify the modification.
